TERMS OF USE
Welcome to the website of IBS Alumni Federation (IBSAF) www.ibsaf.org. This service is provided to the alumni to stay in touch with one another. As part of the service, IBSAF agrees to provide you with e-mail services, mailing lists, bulletin boards/news groups, information libraries, and other computer services that IBSAF may decide to offer, subject to the terms of this Agreement, and modified in the Disclosure. Upon notice published through the Service, IBSAF may modify this Agreement at any time. You agree and continue to agree to use IBSAF services in a manner consistent with all applicable laws and regulations and in accordance with the terms and conditions set out in the policies and guidelines outlined below. Please note that you will be referred to as "Member" from time to time in this Agreement. Member means an alumnus of ICFAI Business School Alumni Federation (IBSAF).
RULES FOR ONLINE CONDUCT
You understand that all information, data, text, software, music, sound, photographs, graphics, videos, messages or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that you, and not IBSAF, are entirely responsible for all Content that you upload, post, email or otherwise transmit via the Service. IBSAF does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. However, it reserves the right to delete any message posted on the IBSAF Website. You understand that by using the Service, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will IBSAF be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed or otherwise transmitted via the Service. You agree to not use the Service to:
a) upload, post, email or otherwise transmit any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
b) upload, post, email or otherwise transmit any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
c) upload, post, email or otherwise transmit any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party;
d) upload, post, email or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation, except in those areas that are designated for such purpose;
e) upload, post, email or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
f) interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to
the Service;
g) copy, reproduce, retransmit, distribute, publish, commercially exploit or otherwise transfer any copyrighted material. IBSAF and/or third-party content providers remain the owners of the posted materials, and that Member does not acquire any of those ownership rights by downloading copyrighted materials. The burden of determining that any information, software or any other content on the service is not protected by copyright rests with the Member.
Members who violate the Terms of Service will receive a warning from moderator or another agent of IBSAF stating that Member has committed a violation and that further violations may result in the termination of Member's account. After one or more warnings, depending on the nature of the violation, IBSAF at its sole discretion may terminate Member's account.
NON-TRANSFERABILITY OF MEMBERSHIP
As the Members of IBSAF are the alumni, their accounts may not be shared, transferred, or sold to other parties, nor are they to be commissioned for use or access by any person or party except the Member. IBSAF grants to Member a personal, non-exclusive, non-assignable and non-transferable license to use the account and avail of the services provided by IBSAF.
E-MAIL SERVICE
IBSAF offers a free webmail account to all alumni who register on the IBSAF website and desire the service. The account will remain accessible to the alum as long as activity is shown and as long as the alum complies with this policy. Activity is defined as having logged into the webmail account within the past three months, having your IBSAF e-mail messages automatically forwarded to another e-mail account. If an alum does not meet one of these criteria, IBSAF reserves the right to deactivate the account. Before any action is taken the alum will be given a 30 days notice via e-mail to meet one of the stated requirements for maintaining an accessible account. If the alum does not show activity within those 30 days, the account may be deactivated and all e-mail, address book entries and personalization in the account will be lost. The e-mail account will be available to the alum for reactivation through IBSAF website, but deleted e-mail will not be able to be recovered. Even if the alum meets one of the activity requirements, the IBSAF reserves the right to discontinue alum’s email access if the alum uses the account in a way that is deemed inappropriate by IBSAF in it’s discretion. Such uses may include, by way of example but not limited to the ones referred to in Rules of Online Conduct. Additionally, the IBS/IBSAF reserves the right generally to terminate the free webmail service at its sole discretion.
LIMITATION OF LIABILITY AND WARRANTY
Each Member expressly agrees that use of the Service is at his or her sole risk. IBSAF does not warrant that these services will be uninterrupted or error free; nor does IBSAF make any warranty as to the results that may be obtained from use of these services or as to the accuracy, reliability or content of any information provided through the service. The disclaimer of liability contained in this section applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, negligence, or under any other cause of action. Each Member specifically acknowledges that IBSAF is not liable for the defamatory, offensive or illegal conduct of other third parties, subscribers, or other Members of the service and that the risk of injury from the foregoing rests entirely with each Member. In no event will IBSAF or any person or entity involved in creating, producing or distributing the service be liable for any direct, indirect, incidental, special or consequential damages arising out of the use of or inability to use the service or out of the breach of any warranty.
IBSAF does not endorse, warrant or guarantee any product or services offered by a third party through the Service and will not be a party to or in any way monitor any transaction between Members and third party providers of products or service.
Neither IBSAF nor any of its agents, affiliates or content providers shall be liable for any direct, indirect, incidental, special or consequential damages arising out of use of the service or inability to gain access to or use the service or out of any breach of any warranty. Member hereby acknowledges that the provisions of this section shall apply to all content on the service.
TRADEMARKS
The IBSAF logo, software code, and all computer-generated graphics on this Service are trademarks of IBSAF. All other trademarks appearing on the Website are trademarks of their respective owners and are duly acknowledged as such.
INDEMNIFICATION
Member agrees to indemnify and hold IBSAF and its subsidiaries, affiliates, officers, agents, and employees harmless from any dispute, which may arise from a breach of terms of this Agreement. Member agrees to hold IBSAF harmless from any claims and expenses, including reasonable attorney's fees and court costs, related to Member's violation of this Agreement, including the Rules of Conduct or any information, software or other content placed on the Service by Member.
TERMINATION OF SERVICE
Member may terminate this Agreement and Member's right to use the Service.
Notwithstanding any of these terms and conditions, IBSAF reserves the right, without notice and in its sole discretion, to terminate your license to use the Site, and to block or prevent future access to and use of the Site.
MERGER CLAUSE
This Agreement constitutes the entire agreement between the parties with respect to the subject matter contained herein and supersedes all previous and contemporaneous agreements, proposals and communications, written or oral between IBSAF representatives and Member. IBSAF may amend or modify this Agreement or impose new conditions at any time upon notice from IBSAF to Member as published through the Service. Any use of the Service by Member after such notice shall be deemed to constitute acceptance by Member of such amendments, modifications or new conditions.
PRIVACY POLICY
IBS Alumni Federation (IBSAF) respects the privacy of IBS alumni and recognises your need for appropriate protection and management of personal information you share with us (such as name, email Id, address, phone no., etc). Personal data privacy is a new and evolving area, and IBSAF is evolving to meet these demands. This site has password-protected, secure areas, which enable alumni to connect with each other. Services included are the Alumni Directory, registration for free online access to select ICFAI publications, access to various job openings, message boards and forums.
The information on this site will not be used for any commercial or philanthropic purpose not directly connected with or approved by IBS; nor will copies be made; nor will the original information or facsimile be given, lent, or sold to any other individual or organization.
When an alumnus subscribes to an e-mail list or provides an e-mail address for other purposes, his or her e-mail address is recorded. That address is used for sending out future mailings via e-mail. That address may also be used for general IBSAF announcements. The e-mail address of a subscriber will never be disclosed to a third party.
Further, we do not store personal preferences, personal information or pages visited on the site in cookies.
